Short-term hire conditions with a driver — applicable from 1 March 2026.

These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern the contractual relationship between DIGITAL PARTNERS EUROPE, a SASU with share capital of 3,000 €, registered with the Bobigny Trade Register under number 995 356 359, operating the Mon Camion Avec Chauffeur (MCAC) platform available at mcac.app (hereinafter “the Platform”), and any individual or legal entity placing an order via the Platform (hereinafter “the Client”).
Any order placed on the Platform implies full and unreserved acceptance of these T&Cs.
MCAC is a platform that connects individuals or businesses needing to transport goods over long distances with independent professional carriers holding their own transport licences, vehicles and insurance.
MCAC acts as an intermediary and is not itself a carrier. The transport service is performed by the partner carrier assigned to the job (hereinafter “the Carrier”), under its own responsibility and its own regulatory authorisations.
In short: MCAC organises, the Carrier performs. The transport contract binds the Client to the Carrier through MCAC’s intermediation.
The service consists of the short-term hire of a commercial vehicle with a driver for the road transport of goods, mainly for long-distance moves.

Each service includes 2 hours of loading and 2 hours of unloading, whatever the truck. Beyond that, every hour started is charged at 135 € incl. VAT per additional hour.
At both pickup and destination, the Client must arrange and guarantee a free, accessible and authorised parking space allowing the truck to approach and carry out loading/unloading. The length to reserve equals the vehicle length plus a manoeuvring margin: +2 m for the 38 m³ truck and +4 m for the 92 m³ truck. The Client is responsible for obtaining any parking permits from their local authority. Any inability to access or park attributable to the Client that causes waiting or an additional trip falls under additional hours (article 3.3).
Other vehicle sizes may be offered later on the Platform.
Orders are placed on the mcac.app Platform as follows:
The booking is deemed firm once the deposit payment is received and MCAC has sent confirmation.
The vehicle provided to the Client is in good working, presentation and maintenance condition. Fuel, lubricants and all consumables necessary for its proper operation are supplied by the Carrier.
The vehicle carries all documents, equipment and accessories required by the Highway Code, tax law and transport regulations.
The Carrier is in charge of and responsible for the driving operations:
The Client shall not take the place of the driver appointed by the Carrier for these operations.
The Client is in charge of and responsible for the transport operations. Accordingly, the Client:
When the driver takes part in the transport operations (loading/unloading help), they act on behalf of and under the responsibility of the Client.
Important: the Client is solely responsible for the weight of the load. Under no circumstances may the weight exceed the vehicle’s payload (1,000 kg maximum). The Client is responsible for the consequences of any overload (fines, immobilisation, extra costs).
The Client undertakes to present their goods properly packed and protected at the time of loading. This condition is essential for the Carrier to take charge of the goods and for the insurance cover to apply.
In the event of breakage or damage to goods whose packing is deemed insufficient or unsuitable, neither the Carrier nor MCAC can be held liable. The driver may record the state of the packing at the time of loading.
The hire price is a fixed, all-inclusive price, calculated by the Platform based on the distance in kilometres, the vehicle volume, the selected options and the chosen date. This price includes the vehicle, the driver, fuel, route costs and transport insurance.

Any late payment automatically triggers, the day after the payment date, late-payment interest equal to five times the statutory interest rate, plus a fixed recovery-cost indemnity of 40 € in accordance with article D. 441-5 of the French Commercial Code.
Loading and unloading times are included in the price within the following limits:

The Client may book additional time slots at 85 € incl. VAT per hour. In the event of an unplanned overrun, additional hours are charged at 120 € incl. VAT per hour (indivisible).
The sums paid at booking are arrhes (deposit) within the meaning of articles 1590 of the Civil Code and L214-1 of the Consumer Code.
If the Client cancels, regardless of the notice given before the moving day, the deposit paid (50% of the total incl. VAT) is retained in full by MCAC and is not refunded. This retention corresponds to the right of withdrawal attached to the deposit (arrhes) regime: a Client who gives up the service forfeits the sums paid in advance.

Cancellation must be notified by email to contact@mcac.app. The date the notice is received prevails. The balance (remaining 50%) is not due if cancellation occurs before loading.
If MCAC or the Carrier cancels, MCAC undertakes to offer the Client an alternative solution (new carrier, new date) as soon as possible. If the Client refuses the proposed solution, the deposit is refunded in full.

If the change alters the price (change of distance, vehicle or options), a new quote is sent to the Client. The Client may accept the new price or keep their original booking.
In accordance with article L. 221-28 of the Consumer Code, the right of withdrawal does not apply to transport services performed on a set date. Booking transport for a fixed date constitutes such a service.
However, the Client benefits from the cancellation terms in article 9 of these T&Cs, which offer greater flexibility than the statutory right of withdrawal.
Each MCAC partner carrier holds its own professional liability insurance, covering damage to the goods carried up to a guaranteed minimum of 300,000 € per claim.
The Carrier holds motor third-party liability insurance in accordance with the Act of 5 July 1985 and article L.211-1 of the Insurance Code. This cover applies to mainland France and the countries of the European Union.
As a connecting platform, MCAC cannot be held liable for damage to goods occurring during transport. Responsibility for the transport lies with the appointed professional Carrier. MCAC nonetheless undertakes to support the Client in their steps in the event of a claim.
The Carrier is solely responsible for Highway Code offences arising from driving the vehicle or from its staff.
Fines resulting from instructions given by the Client (imposed route, requested illegal parking, etc.) remain the Client’s responsibility.
The Carrier equips the vehicle with all documents required by transport regulations. The Client is subject to all obligations relating to the goods they have carried.
If the vehicle is immobilised for any reason, the Carrier provides, subject to availability, a replacement vehicle able to perform the service.
If the vehicle breaks down during the job, the Carrier arranges repairs as soon as possible and, where necessary, a replacement, with no additional charge to the Client arising from the breakdown.
Any complaint about the performance of the transport must be sent to MCAC within 7 business days of delivery, by email to contact@mcac.app.
The complaint must be accompanied by any relevant supporting evidence (photos of the damage, detailed description, estimate of the loss). MCAC forwards the complaint to the Carrier and supports the Client in resolving the dispute.
In accordance with articles L. 611-1 et seq. of the Consumer Code, in the event of a dispute not resolved amicably, the consumer Client may use the mediation service free of charge.

The Client may also submit their dispute via the European online dispute resolution platform: ec.europa.eu/consumers/odr.
Personal data collected in connection with the order is processed in accordance with our Privacy policy, in compliance with the General Data Protection Regulation (GDPR).
These T&Cs are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts have sole jurisdiction.
For disputes involving a consumer, the competent court is that of the defendant’s domicile or, at the claimant’s choice, that of the place where the service was actually delivered.
